Sean or Michelle, does 1695 apply when the equity seller has listed the property with a broker for sale after the NOD has been recorded,i.e., you make an offer through your buyers agent as opposed to approaching the seller/owner directly without the property being listed for sale? thanks

It is my understanding that this code applies regardless if you are using a realtor and they have listed the property. I know that a few years ago this law actually required agents representing investors on properties where a Notice of Default was filed to post a special bond. The hook was that there was no one selling the bond. That requirement was lifted and now realtors can represent investors.
