I noticed a property scheduled for auction has a very recent grant deed in which the original owner grants the property to 10+ people (including herself as the grantee). I don’t know if those names are for real persons or faked.
Is this a new tactic to fight foreclosure?
We have seen this used as a method to try to delay the foreclosure. The actual tactic usually involves transferring a small percentage of ownership to an individual that has an active BK. This could potentially cause a temporary delay but will not completely stop the foreclosure process.
The simple act of filing a grant deed and transferring title will not typically delay a foreclosure but would certainly provide you clues to the owners state of mind regarding the foreclosure and potential eviction. This would lead me to believe that they are going to put up a fight.
