If a property brought off from auction (senior loan) which has a transfer tax lien with city of Oakland, will the new owner need to pay?
? ?Good question. ?Most title companies make you pay off City garbage liens and abatement liens, so I assume this has the same priority. ?I never have seen this kind of lien. ? Could the lien have been created when borrower transferred title in an effort to block the fcl? ? ?Alameda County does let you record Deeds w.o. paying transfer taxes. ?I would challenge this. ?IF this were allowed to stand, I could see a?deranged?borrower record several deeds showing a high price, each incurring a large transfer tax.
